This Privacy Policy describes Factual Soft Company LLC’s (“Factual Soft,” “we,” “us” or “our”) practices regarding the collection, use and disclosure of the information we collect from and about you and other individuals when you use Factual Soft’s cloud-based and desktop software applications, including without limitation RapidDox™ family of products (collectively, the “Service”). Subscription to and the purchase of the Service is made and certain aspects of the Service are provided through Factual Soft’s website dedicated to the Service and located at https://rapiddox.com (the “Website”). We take our obligations regarding your privacy seriously and have made every effort to draft this Privacy Policy in a manner that is clear and easy for you to understand. By accessing or using the Website or the Service, you agree to this Privacy Policy, our Acceptable Use Policy and, as applicable, our Terms of Service for cloud-based software services, our End User License Agreement for desktop software.

Our Collection and Use of Information

Information You Provide to Us

We collect certain personal information, such as your name and email address, when you register for an account for the Service on our Website. Your user name, email address, other information required by our registration and onboarding process on the Website and any optional profile information that you elect to associate with your account with us is referred to herein as your “Profile Information.”

We will utilize a third party credit card payment processing company to collect payment information, including your credit card number, billing address and phone number. We will share this payment information with the third party processing company as detailed below in “How We Share Your Information: With Trusted Service Providers and Business Partners.” We do not store your payment information.

We may use your email address to send you Service-related notices (including any notices required by law, in lieu of communication by postal mail). We may also use your email address to send you announcements and information about other products or services (including third party services) that you may be interested in (together, the “Marketing Messages”). You may opt-out of receiving Marketing Messages at any time by following the instructions provided in the Marketing Message. Through your account interface, you may also opt-out of receiving categories of Service-related notices that are not deemed by Factual Soft to be integral to your use of the Service.

Even if you are not a registered user of our Website or a subscriber to the Service, if you email us or contact us through the Website we may retain a record of such email communication, including your email address, the content of your email, and our response.

If you choose to use our invitation service to invite a friend to the Service, we will ask you for that person’s contact information, which may include their email address or their social network identity, and automatically send an invitation. Factual Soft stores the information you provide to send the invitation, to register your friend if your invitation is accepted, and to track the success of our invitation service.

Your Business Data

If you subscribe to or purchase a software license for the Service, your use of the Service will involve you uploading or inputting various data and content into the Service for your own business purposes (together, the “Business Data”). The Business Data may contain personal information of other individuals, such as your own employees, business partners, customers or other third persons held in your systems or databases, that you or your consultants and other independent contractors wish to process through the Service.

You, as our customer, control how your Business Data is shared with others once you obtain the output provided by the Service. When providing the Service, Factual Soft only processes metadata contained in your Business Data on your behalf of and in accordance with your instructions as a customer of Factual Soft. Our Service contains automated processes and workflows and other software that generally allow customers to control how they process the Business Data they choose to input into the Service, and we do not typically control these processes or store such data or content other than as may be necessary to provide the Service. Business Data uploaded through the Service is stored only temporarily and is automatically deleted upon the completion of an online session. The Terms of Service for cloud-based software services and the End User License Agreement for the desktop software between Factual Soft and its customers define specific roles and responsibilities of the parties for the processing of Business Data in the context of the Service.

If you are not our customer but believe that your personal information is used by our customer in the context of the Service, for more information on these activities please refer to the privacy policy of our customer who collected and inputted your personal information into the Service.

Factual Soft may retrieve, view, analyze, copy and display your Business Data only as necessary (i) to maintain, provide and improve the Service; (ii) to resolve a support request from you; (iii) if we have a good faith belief, or have received a complaint alleging, that such Business Data is in violation of our Acceptable Use Policies; (iv) as reasonably necessary to allow Factual Soft to comply with or avoid the violation of applicable law or regulation; or (v) to comply with a valid legal subpoena or request. We may also analyze the Business Data in aggregate and on an anonymized basis, in order to better understand the manner in which our Service is being used. We do not store your Business Data permanently and do not perform backups of your Business Data but may have access to it as the Business Data passes through our systems and our partners’ servers and networks as we provide the Service to our customers.

Information We Collect Automatically

Log Files

When you use the Service, our servers automatically record certain information in server logs. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type and settings, referring / exit pages and URLs, number of clicks and how you interact with links on the Service, domain names, landing pages, pages viewed, mobile carrier, date and time stamp information and other such information. Log files help us to monitor, analyze, improve and maintain the Service and to diagnose and fix any Service-related issues.

Device Identifiers

When you access the Service using a mobile device or your desktop computer, we collect specific device information contained in your mobile device’s or computer’s “device identifier.” This device identifier includes information such as the type of device you are using, its operating system, and, with respect to mobile devices, mobile network information, which may include your mobile phone number. We may associate this device identifier with your Service account and will use data associated with your device identifier to customize our Services to your device and to analyze any device-related issues.

Location Information

We may collect and process information about the location of the device from which you are accessing the Service. Location data may convey information about how you browse the Website or use the Service and may be used in conjunction with personally identifiable information.

Information we obtain from other sources

Where permitted by applicable law, we may collect and use information about you from other sources, including through interactive applications (e.g., mobile devices, third party services, and embedded audio and video players), from co-branded partners and websites (e.g., on our social media pages), and from commercially available sources (e.g., data aggregators and public databases).

Please note that all of the information we collect about you may be combined, including to help us tailor our communications to you and to develop and improve our services on the Website and within our Service.

Our Cookie Policy

Factual Soft uses technologies like cookies, pixel tags and web beacons to provide, monitor, analyze, promote and improve the Website and the Service. For example, a cookie is used to remember your user name when you return to the Website or the Service and to improve our understanding of how you interact with the Website and the Service. You can block cookies on your web browser; however please be aware that some features of the Website and the Service may not function properly if the ability to accept cookies is disabled. You may disable or block cookies by adjusting your browser preferences at any time; however, please be aware that some features of the Website or the Service may not function properly if the ability to accept cookies is disabled. We may utilize third-party service providers to provide us with analytics services and to serve advertisements on our behalf across the Internet. These parties may utilize cookies or similar technologies to gather information about your browsing activities over time and across different websites following your use of the Website or the Service. For example, we may use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help the website analyze how users use the Service and to enhance their experience when they use the Website or the Service. We do not currently recognize or respond to browser-initiated Do Not Track signals that provide a method to opt out of the collection of information about online activities over time and across third-party websites or online services as there is no consistent industry standard for compliance.

How We Share Your Information

We may share the information we collect from you with third parties as detailed below.

As Directed By You

We will display your Profile Information on your profile page and elsewhere within the Service in accordance with the preferences you set in your account. You can review and revise your Profile Information at any time.

We will display your Business Data within the Service as directed by you.

If you elect to use a third party application to access the Service, then we may share or disclose your account and Profile Information and your Business Data with that third party application as directed by you. Please remember that we are not responsible for the privacy practices of such third parties so you should make sure you trust the application and that it has a privacy policy acceptable to you.

With Trusted Service Providers and Business Partners

We may utilize trusted third party service providers to assist us in delivering, improving, protecting and promoting our Service. For example, we may use third parties to help host our Service, send out email updates, perform analyses related to the operation of our Service, or process payments. We may also store personal information in locations outside the direct control of Factual Soft (for instance, on servers or databases co-located with hosting providers).
These service providers may have access to your information for the limited purpose of providing the service we have contracted with them to provide. They are required to have a privacy policy and security standards in place that are at least as protective of your information as is this Privacy Policy.

With Law Enforcement or In Order to Protect Our Rights

We may disclose your information (including your personally identifiable information) in response to a lawful request by public authorities, including to meet national security or law enforcement requirements. We may also disclose your information to our legal counsel, governmental authorities or law enforcement if we believe that it is reasonably necessary to do so in order to comply with a law or regulation; to protect the safety of any person; to address fraud, security or technical issues; or to protect Factual Soft’s rights or property.

In an Aggregate and Non-Personally Identifiable Manner

We may disclose aggregate non-personally identifiable information (such as aggregate and anonymous usage data, platform types, etc.) about the overall use of our Website and the Service publicly or with interested third parties to help them understand, or to help us improve, the Website and the Service.

In Connection With a Sale or Change of Control

If the ownership of all or substantially all of our business changes, we may transfer your information to the new owner so that the Website and the Service can continue to operate. In such case, your information would remain subject to the promises and commitments contained in this Privacy Policy until such time as this Privacy Policy is updated or amended by the acquiring party upon notice to you.

Third Party Advertisers

From time to time, we may display advertisements on the Website or the Service that are delivered to our users from our advertising partners. We may show you advertised content in several different areas of the Website or the Service. We will not share personally identifiable information with any third-party advertiser or ad network. However, our advertising partners may use cookies and clear gifs on the Website, the Service and/or on their own websites. We encourage you to read our advertising partners’ privacy policies to see how they use the information they gather.

Links to Other Sites

From time to time, we may display links to other websites that are not owned or controlled by Factual Soft. We are not responsible for the privacy practices of such other websites or any cloud-based software, mobile or desktop application and tools hosted or provided through such third party websites. As stated above, this Privacy Policy applies only to information collected by Factual Soft from the visitors and registered users of our Website and our customers subscribing or purchasing the Service.
When you leave the Website or the Service and access these other websites, you should always read the privacy policies or statements of each and every website that collects your personally identifiable information. Your use of a third-party website, cloud- based software, desktop or mobile application will generally subject you to that party’s privacy policy.

How We Protect Your Information

The security of your information is important to us. When you enter sensitive information (such as a credit card number) as part of our service, we arrange for the transmission of that information to be encrypted using industry-standard encryption.
Factual Soft uses commercially reasonable and industry-standard physical, managerial, and technical safeguards to preserve the integrity and security of your information. For example, we guard against common web attack vectors, host data in secure Amazon Web Services, and implement firewalls and access restrictions on our servers to secure our network and better protect your information.

Risks Inherent in Sharing Information

Although we allow you control over where you share your Business Data and what information is included in your Profile Information and take reasonable steps to maintain the security if the information associated with your account, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of others with whom you share your Business Data and we are not responsible for third party circumvention of any privacy settings or security measures within the Service.

Your Choices About Your Information

You may, of course, decline to submit personally identifiable information through the Website or the Service, in which case Factual Soft may not be able to provide certain services to you. You have a right to access information we hold about you. You may update or correct your account information at any time by logging in to your account and modifying your Profile Information. Children’s Privacy

Our Service is not directed to persons under 13. Factual Soft does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register for an account on the Website. If we become aware that we have collected personal information from a child under age 13 without verification of parental consent, we take steps to remove that information. International Data Transfer

We may transfer information that we collect about you, including personally identifiable information, to affiliated entities, or to other third parties (as provided herein) across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, and you consent to the transfer of information to the U.S. and the use and disclosure of information about you, including personal information, as described in this Privacy Policy.

Links to Other Web Sites

We are not responsible for the practices employed by websites linked to or from within the Website or the Service, nor the information or content contained therein. Please remember that when you use a link to go from the Website or the Service to another website, our Privacy Policy is no longer in effect and your activities on that third party website is subject to such third party website’s own rules and policies.

Do Not Track Signals

Some browsers have a “do not track” feature that lets you tell websites that you do not want to have your online activities tracked. We currently do not respond to “do not track” signals.

Changes to Our Privacy Policy

If we change our Privacy Policy, we will post those changes on this page to keep you aware of what information we collect, how we use it and under what circumstances we may disclose it. Changes to this Privacy Policy are effective when they are posted on this page.
